DEFINITIONS

‘IAM Marrakech’ or ‘Us’ or ‘We’ or ‘Our’ refers to IAM Marrakech, the owner of the website www.iammarrakech.com
‘Instructor’ refers to the individual(s) providing wellness, mindfulness, or other teaching services during a Retreat.
‘Curated Experience’ refers to any holiday, accommodation, activity, or event organised by Us.
‘Retreat’ refers to any holiday, accommodation, activity, or event organised by Us.
‘Participant’ or ‘You’ or ‘Guest’ refers to the individual viewing this website or the person who books Our Curated Experience and/or Retreat.
‘Supplier’ refers to the hotel, third party, collaborator, company, or person that is hosting the Retreat or providing a part of it.
‘Price’ refers to the total cost of the Retreat.
‘Activities’ refers to excursions, workshops, events, and other parts of the curated schedule including wellness or mindfulness sessions.

1. General Terms

Acceptance of Terms: By accessing and using our website, you accept and agree to be bound by these Terms & Conditions and our Privacy Policy.
Changes to Terms: We reserve the right to modify these terms at any time. Any changes will be posted on this page and will become effective immediately upon posting. Your continued use of the website after changes have been posted constitutes your acceptance of the revised terms.
Privacy and Data Protection: We are committed to protecting your privacy. Any personal information collected through our website—such as for enquiries, bookings, or mailing lists—is handled in accordance with our Privacy Policy and applicable data protection laws. By using our website, you consent to the collection and use of your information as outlined in our Privacy Policy. Our website may also use cookies to enhance user experience and analyse site traffic. You can manage your cookie preferences through your browser settings.

2. Bookings and Payments

Deposit: A 50% deposit is required at the time of booking to secure your booking. Bookings are only confirmed once the deposit is paid and a confirmation is sent by us.
Final Payment: The remaining 50% balance must be paid no later than 8 weeks before the event start date.
Refund Policy: Deposits can be refunded in full (excluding Curating Fees & Admin Costs), minus a 7.5% bank charge, if cancellation is received at least 8 weeks before the event start date. No refunds will be issued for cancellations made less than 8 weeks before the event start date.
Currency and Payment Methods: All payments are to be made in GBP using the payment methods specified at the time of booking.

3. Additional Charges

Program Modifications: Any changes requested by the client to the agreed curated program will incur additional charges, which will be communicated and agreed upon prior to implementation.

Additional Meals: Any meals outside the official curated program, including personal restaurant choices are at the client’s expense. If the facilitator is required to join, their meal cost will also be borne by the client. Drinks are not included in meal costs unless stated otherwise.

4. Cancellation Policy

Participant Cancellations: Deposits can be refunded in full (excluding Curating Fees & Admin Costs), minus a 7.5% bank charge, if cancellation is received at least 8 weeks before the event start date. No refunds will be issued for cancellations made less than 8 weeks before the event start date.
No-Show Policy: Failure to attend the program’s activities without prior written 8 weeks notice will be considered a last-minute cancellation. In such cases, no refunds will be issued, and the full amount of the retreat will be forfeited.
Force Majeure: IAM Marrakech is not liable for cancellations, changes, or delays due to events outside of our control, including but not limited to natural disasters, pandemics, or other unforeseeable circumstances that may force us to cancel the retreat. In such cases, we will not be responsible for any costs or losses incurred by participants.

5. Use of Our Services

Eligibility: You must be at least 18 years old to use our services. Participants under the age of 18 must be accompanied by a responsible adult and have written permission from a parent or legal guardian to participate in the retreat.
Conduct: You agree to use our website and services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the website.
Medical Acknowledgment and Disclaimer: By participating in any activities during the IAM Marrakech Retreat, you acknowledge that you are doing so voluntarily and at your own risk. You confirm that you are physically and mentally capable of participating in the scheduled activities and have no medical condition that would prevent your safe participation.

IAM Marrakech and its facilitators are not liable for any injuries, health conditions, or medical issues that may arise during or after the retreat, including those related to pre-existing conditions. We strongly recommend consulting your healthcare provider before attending the retreat.

Travel and Insurance: You are responsible for arranging your travel to and from the curated program location in Morocco, and for obtaining adequate travel insurance to cover medical expenses, personal injury, and any other risks associated with travel and participation in the retreat.
Final Itinerary: We reserve the right to amend the itinerary. While we strive to provide an accurate representation of the program schedule, unforeseen circumstances may necessitate changes. These changes may include alterations to activities, timings, and locations. We will make every effort to ensure that any changes minimally impact your experience.
Code of Conduct: Participants are expected to behave respectfully and responsibly at all times during the retreat. Unacceptable conduct, including but not limited to harassment, verbal or physical abuse, disruptive behavior, or excessive intoxication will not be tolerated. IAM Marrakech reserves the right to remove any participant from the retreat without refund if their behavior is deemed inappropriate, harmful, or disruptive to the experience of others or the integrity of the program.

6. Intellectual Property

Ownership: All content on this website, including text, graphics, logos, and images, is the property of IAM Marrakech or its content suppliers and is protected by copyright and other intellectual property laws.
Use: You may not reproduce, distribute, or use any content from this website without our prior written permission.

7. Liability

Disclaimer: The information on our website is provided on an "as is" basis without any warranties of any kind. IAM Marrakech does not guarantee the accuracy, completeness, or reliability of any information on our website.
Limitation of Liability: To the fullest extent permitted by law, IAM Marrakech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use of our services; (ii) any unauthorised access to or use of our servers and/or any personal information stored therein.
Local Laws and Regulations: Participants are responsible for complying with all local laws and regulations during their stay in Morocco.

8. Third-Party Links

Our website may contain links to third-party websites or services that are not owned or controlled by IAM Marrakech. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that IAM Marrakech shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

9. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. International Clients

Visa and Entry Requirements: It is your (the participant) responsibility to ensure that you have the necessary travel documents, including passports and visas, to enter Morocco.
Health and Vaccinations: You (the participant) are responsible for ensuring that you meet any health and vaccination requirements for travels to Morocco.
Travel Insurance Recommendation: All participants are strongly advised to obtain comprehensive travel insurance that covers trip cancellation, medical expenses, personal injury, loss or damage of belongings, and emergency repatriation. Participation in the IAM Marrakech Retreat is at your own risk, and IAM Marrakech will not be held liable for any costs or losses incurred due to insufficient or absent insurance coverage.
